Thank you for choosing 850Photography. These terms outline the agreement between you (the client) and 850Photography regarding our real estate media services. By booking a session with us, you acknowledge and agree to the following terms. We want every experience to be smooth and transparent -- please read through these so we're on the same page.
Scope of Services
850Photography provides professional real estate media services including but not limited to: HDR interior and exterior photography, aerial drone photography, 3D virtual tours, 2D floor plans, virtual staging, virtual twilight editing, property videography, and vacant lot media coverage.
All services are performed within our designated service area and are subject to availability. Specific deliverables for each booking are determined by the package or service selected at the time of scheduling.
Booking & Scheduling
All bookings are made through our online scheduling portal or by contacting us directly. By placing a booking, you agree to these terms and confirm that you have authorization to access the property on the scheduled date and time.
It is the client's responsibility to ensure the property is accessible, clean, and photo-ready before the scheduled appointment. Properties that are not prepared may result in subpar results, and 850Photography is not responsible for the condition of the property at the time of the shoot.
Property Preparation
The property must be photo-ready prior to our arrival. This includes tidying rooms, removing personal clutter, turning on all interior lights, opening blinds and curtains, and ensuring landscaping is presentable.
Our team may make minor adjustments on-site such as straightening pillows, adjusting blinds, or turning on additional lights. However, we do not move furniture, large items, or personal belongings. We are not responsible for any items at the property.
If the property is not in a reasonably prepared state upon arrival, we reserve the right to proceed with the shoot as-is or reschedule with applicable fees.
Delivery & Turnaround
Standard photography packages are delivered within 24 hours of the completed shoot, typically by the next business day. Video projects and specialty edits (virtual staging, virtual twilight) may require 2-5 business days depending on scope and current volume.
Delivery is made via an online gallery link sent to the email provided at the time of booking. Service is considered complete upon delivery of the gallery or proof, regardless of whether the client downloads or uses the media.
Rush turnaround requests are accommodated when possible but are not guaranteed and may incur additional fees.
Payment Terms
Payment is due upon completion of the shoot or prior to delivery of final media, depending on the service booked. All major credit and debit cards are accepted.
Services are non-refundable once the appointment has been completed and media has been delivered. Outstanding balances may result in restricted access to delivered media until payment is received in full.
Cancellations & Rescheduling
Cancellations made more than 24 hours before the scheduled appointment may be made without penalty. Cancellations within 24 hours of the scheduled time may be subject to a cancellation fee.
Rescheduling is permitted up to 8 hours before your appointment at no charge. Rescheduling requests made within 8 hours are handled on a case-by-case basis and may incur a fee.
No-shows without prior notice will be charged the full service amount.
Weather Policy
Weather on the Panhandle can be unpredictable. If adverse weather conditions (rain, storms, dense fog, or unsafe wind speeds) affect the quality of exterior or drone photography, we will work with you to reschedule at no additional cost.
Drone operations are subject to FAA regulations and cannot be performed in rain, fog, or wind speeds exceeding safe operational limits. If only drone work is affected, we may complete interior and ground-level photography on the scheduled date and return for drone coverage when conditions improve.
The decision to reschedule due to weather is made at the discretion of the photographer to ensure the highest quality results. Overcast skies alone do not constitute grounds for rescheduling.
Drone & Aerial Operations
All drone operations are conducted by FAA Part 107 certified pilots in full compliance with federal, state, and local regulations. Certain areas may have airspace restrictions (airports, military zones, TFRs) that prevent or limit drone operations.
If drone photography cannot be safely or legally performed at a property, the client will be notified and alternative arrangements will be discussed. Inability to fly due to airspace restrictions does not constitute grounds for a refund of the full package.
Media Licensing & Usage Rights
Upon full payment, the client receives a non-exclusive license to use the delivered media for marketing purposes related to the property photographed. This includes MLS listings, real estate websites, social media marketing, vacation rental platforms (Airbnb, VRBO, etc.), print marketing materials, and personal portfolio use.
The license is granted to the original client or company that placed the order and is not automatically transferable to new agents, brokerages, or property owners. If the property changes representation, a license transfer may be required.
850Photography retains full copyright ownership of all media produced. This means we may use the work in our own portfolio, website, social media, and marketing materials.
Prohibited Uses
The following uses of delivered media are strictly prohibited without prior written consent:
- Resale, redistribution, or sublicensing to any third party
- Use for properties other than the one originally photographed
- Heavy re-editing, manipulation, or alteration beyond basic cropping and resizing
- Removal or modification of embedded metadata or watermarks
- Uploading to or processing through AI-powered tools or generators
- Stock photography databases or any commercial use unrelated to the property listing
Violation of these terms may result in revocation of the usage license and pursuit of appropriate remedies.
Revisions & Reshoots
If there is a legitimate issue with the delivered media (e.g., a room was missed, a technical error occurred), please contact us within 7 days of delivery and we will make it right at no additional charge.
Requests for reshoots based on subjective preference, dissatisfaction with marketing performance, or changes made to the property after the shoot do not qualify for complimentary reshoots and will be quoted as a new service.
Video projects include one round of revisions at no extra cost. Additional revision rounds may incur fees depending on the scope of changes requested.
Liability & Disclaimers
850Photography carries liability insurance for all operations. However, we are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services or delivered media.
We do not guarantee any specific sales results, rental performance, booking volume, lead generation, or marketing outcomes from the use of our media. Real estate photography is a marketing tool, and results depend on many factors outside of our control.
In the unlikely event of equipment failure or data loss, our liability is limited to a reshoot of the property at no additional cost, scheduled at the earliest mutually available time.
File Storage & Retention
Delivered media galleries remain accessible for a reasonable period after delivery. However, 850Photography does not guarantee long-term archival storage beyond 90 days from the date of delivery.
Clients are strongly encouraged to download and back up all delivered files promptly. Re-delivery requests for expired galleries may incur a retrieval fee if the files are still available.
Service Area & Travel
Our standard service area covers the Panhandle and surrounding communities. Properties within this area are serviced at standard package rates.
For properties outside our standard service area, a travel fee may apply depending on distance. Travel fees will be communicated prior to booking confirmation.
Occupied Properties
For occupied properties, it is the client's responsibility to coordinate with the homeowner or tenants to ensure personal items, valuables, and private belongings are secured prior to the shoot.
If personal items are visible in delivered media, this does not entitle the property owner or occupant to compensation, additional editing, or a reshoot. We recommend discussing the shoot with occupants beforehand and ensuring sensitive items are put away.
